1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Quizly ("Service") operated by Quizly ("we," "us," or "our") at https://tryquizly.com. By accessing or using our Service, you agree to be bound by these Terms.

2. Service Description

Quizly is an AI-powered quiz generation service designed for educators. You can upload content (PDFs, DOCX documents, and images) and our AI processes that content to generate printable quizzes with multiple question types including multiple choice, true/false, short answer, and essay questions.

3. Account Terms

To use Quizly, you must register for an account using a valid email address or through Google OAuth. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

4. Subscriptions and Payments

Quizly offers a 14-day free trial for new accounts. After the trial period, continued access to quiz generation requires a paid subscription. We offer Basic ($5/month), Pro ($15/month), and Enterprise ($49/month) plans.

All payments are processed through Stripe. Subscriptions renew automatically each month unless cancelled. You may cancel your subscription at any time, and you will retain access to paid features until the end of your current billing period. We do not offer refunds for the current billing period after cancellation.

5. AI-Generated Content

Quiz questions are generated by artificial intelligence based on the content you upload. While we strive for accuracy, we do not guarantee that AI-generated questions are error-free, complete, or appropriate for all educational contexts. You are responsible for reviewing all generated quizzes before using them with students.

6. User Content and Uploads

You retain full ownership of all content you upload to Quizly. By uploading content, you grant us a limited license to process that content solely for the purpose of generating quizzes on your behalf. We do not use your uploaded content to train AI models. You may delete your uploaded content at any time through the content library.

7. Acceptable Use

You agree not to:

Upload content that is illegal, harmful, or infringing
Attempt to reverse-engineer, exploit, or abuse the Service
Use the Service to generate content that is misleading, defamatory, or harmful
Share your account credentials with others
Interfere with the operation of the Service or other users' access to it

8. Intellectual Property

Quizly and its original content, features, and functionality are owned by Quizly and are protected by copyright and other intellectual property laws. You own the content you upload and the quizzes you generate using that content.

9. Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users. You may cancel your account at any time. Upon termination, your right to use the Service ceases immediately, and we may delete your data after a reasonable retention period.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

11. Limitation of Liability

To the maximum extent permitted by law, Quizly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or relating to your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make significant changes, we will notify you via email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
